Lane trial in holding pattern

(Viera, Florida) State Attorney Tom Brown said he has been in a holding pattern for months waiting on the test results and decision of Billy Lane’s defense attorney Gregory Eisenmenger. Judge Allawas told Eisenmenger that she expects all motions and decisions to be made by no later than June 6th and scheduled the next pretrial hearing for June 12th when she expects to set a trail date in the DUI Manslaughter case that Lane has been faced with for almost two years now.
Eisenmenger told the court that he expects to have reached a decision on how he plans to use his expert witness within 30-45 days, sooner if she required it. “The results are back, I have not had a chance to look them over yet” Eisenmenger said to the court with his arm in a sling. I have an obvious injury and my assistant Mr. Barry is scheduled for surgery on Monday, hopefully we will be able to get this resolved as we both recuperate. Eisenmenger and Barry have not reached a decision on how that are planning on using the blood test results and expert witness for trial. There was an administrative hearing that had some unexpected issues resulting in their uncertainty. Based on these results we will determine if we plan on using Masten as a expert witness or just a consultant, Eisenmenger told the court. There is a 50 50 chance of us using him either way at this time.
State Attorney Tom Brown said that until Eisenmenger makes his decision, he has no choice but to wait. It will be based on the decision of Eisenmenger as to how we will proceed with the depositions in the case. We can not do the deposition of the witness without knowing what to ask and until we see the results ourselves we have to wait. After looking over some notes in the case, Judge Allawas reminded Attorney Eisenmenger of statements made by Ken Barry in previous hearings as to the expected time line.

Billy Lane, his Mother and Byron Morelock spoke outside the courthouse for some time. Byron was hoping to hear news of a trial date being set today, but was set back at further delays in the DUI Manslaughter trial related to the death of his brother Gerald Morelock. Byron and Billy have been talking about working out something positive toward what has happened, but no certain plans can be announced yet.

Billy & Byron are talking? Is there a strong chance things are over before the next June 12th date?
As far as Ms. Derrick, I would assume she wants to cash in if possible. I mean she used to have pictures up on her Myspace of herself & Billy from the night this accident happened, before the accident & I also know she is no longer an aquaintence of Billy. I just don’t see how she will recieve money when she is waiting for over 2 years to try & the fact she was also in the vehicle with Billy. Sorry but if I am a judge, some of these people need to use common sense. I would say to this young lady, dear, maybe the next time you want to drink & ride on the back of a man’s motorcycle who is 15 years older then you & the jump into his truck, you will think twice. Then award her whatever her medical bills cost & send he on her way. Enogh using laws suits to get money.

Yea Brett it is kind of strange how Erin was so quiet for all this time and then suddenly makes this decision. I am sure it will never get to court though. I have an update on her and her suit that I am putting together now. Thanks for dropping by and your thoughts.

well I don’t want to really talk about Erin.
I am more interested in the Billy & Byron. I mean 2 years ago did anyone think they would be standing within 100 feet of each other & Byron smiling while talking to Billy’s mom? They really do need to put this to rest 1 way or another. I can’t believe over 2 years of this has been easy for either of the families. & no matter what people want to believe, it is pretty clear Billy has already lost alot of what he had. Maybe hidden & waiting for the end of this to come out again?? I don’t know.

ike,Brett)been stalking her, just because she has laid low doesn’t mean things haven’t been going on. You guys just can’t stand it because you didn’t know about it and why do you care ??? If Billy and his mother talks to Byron, what business is it of yours. Fla Today didn’t have alot of the facts correct in their article, you guys want to believe everything you read and that is sad. I don’t want to hear about all the legal bull that your going to throw out at me that the lawsuit states, you should know some of the legal procedures that have to be taken when medical bills etc. are involved….Mike you pull up everyone’s background, lawsuits, court reportings, you should know how the system works. You guys can believe all the hype you want, there is alot of facts that you guys are dead wrong about…and it will come out ! All the little remarks about Erin and what was going on when the accident occurred, well one day we will have proof that is not true and all of you will be eating your words.

Hi LJava,
I don’t recall any of the remarks as to what might have been going on at the time of the accident appearing here on this blog, but I might be wrong as it has been a long time.
What I was saying about Erin being quiet is that she has not been very vocal to the public and had not taken any legal action (until now) that I am aware of. Florida Today having errors in their article is not new, however I think most of the time Ms. Summers has been pretty accurate and she did spend a great length of time talking with Eisenmenger. Some of which I was present for and some not.
As to the meeting with Mr. Morelock and the Lane family, I am in hope of them working things out to have some sort of a positive outcome and maybe Billy will move forward in a proactive manner with this. That will remain to be seen.
I can understand your getting wires crossed on what you might have read where though, as there are many other sources that have covered this story. Many of them are either a copy and paste reporting site or they change the wording to call it their own news. I report what I see and hear.

LJava, I will just say, when all this happened, I sent a message to Erin at her MySpace page advising she take down all the pictures she had of herself & Billy from the Cocoa Beach Club or whatever & then sent her some links to all the “Chopper Forums” that had threads about her & Billy from that night & how they were linking to the pictures I suggested she remove.
Not only did the pictures go, but her original MySpace page was removed also. I don’t know what their relationship was & don’t care. The fact is, she was not forced onto his bike or into his truck. She was with him as either a friend or lover for a while. At the time she was 22 & he was 36. Just seems like a star truck kid who needed to make better judgements.
Finally, what business is it of ours?? Well this is a blog about motorcycles & the motorcycle industry. Billy Lane is a major part of the custom motorcycle industry. People are going to talk about it. Sorry. It’s the way things go since the internet came about. Your business becomes everyone’s business unless no one cares about you.

I am quite sure that the Morelocks feel much better now that they have been made millionaires. They are quite chummy now. As for Billy Lane….if you can pat high dollar lawyers, you have a much better chance of getting out of a big mess.

That is a sad statement & if it is true I could only shake my head. How do you put a price on a loved one?
Honestly, through out this entire thing, I have taken the stance as what would you do if you best friend or brother were in Billy Lane’s shoes.
If there is now honest forgiveness from Byron to Billy & they just want this over & to come up with a positive outcome, then that is great. However if the change of heart from Byron is because of dollars, I feel bad for him.

I agree with you Brett!
First off the amount that the family received was not disclosed, so there is no way we can say millionaire. I think there is a cap on these type of suits and it is way below that, I may be wrong on that though.
However, Lucy1921, look at it this way.
Pick out a family member that you really love and hold them in your mind. Now someone hands you a check for say….even a million dollars. There is only one catch. That family member is instantly gone! You never get to say goodbye or tell them how much you love them. You will never get to touch them or hear their voice again.
Is it worth the trade? Thank about it.
Brett, I can assure you that it is the latter. Byron has really had to work hard at being the man that he is and facing Billy with a move forward attitude.

No amount of money is worth a trade of any amount of money. Gerald’s family has certainly improved their quality of life and for the better as far as what they have in the bank compared to their banks accounts before the untimely death of their loved one.Byron purchased a new car within a month of the settlement….that looks like the new found cash was burning a hole in his bank account. It is just sad no matter how one shakes a stick at this ugly event. Guess Byron can send the Lane’s a Christmas card. I wish them well.
