Space Shuttle Launch is still a GO!

Preparing for launch

The space shuttle Discovery is ready to go with all systems normal, however NASA said there is a 60% chance of weather delaying the 9:35 pm launch.

I am really hoping for this launch. It has been many years since I can remember a night launch of the space shuttle. There is a cold front coming through that threatens forming a cloud cover blanket that would take away the viewing distance of the launch and it may cause the launch to be postponed.

DaimlerChrysler files affirmative defenses

(Melbourne, Florida) 12/06/2006 Answer to wrongful death complaint in the Brevard County court of Dolores J. Morelock Vs. William D Lane and DaimlerChrysler Corporation.

Dodge files answer in wrongful death suit

William McCandless, attorney for the defendant, DaimlerChrysler Corporation filed an answer in the civil suit against the company and Billy Lane for the Wrongful Death of Gerald Morelock. The document was filed on November 15, 2006 with the Brevard Clerk of Courts and a copy has been served on Nance, Cacciatore and Hamilton, the attorneys for the plaintiff.

Before I get into the answer, I want to add to the top of this post, the definition of the legal term that you will see used throughout the text of this document. The legal term definitions used on this blog are provided by law.com.

affirmative defenses: part of an answer to a charge or complaint in which a defendant takes the offense and responds to the allegations with his/her own charges, which are called “affirmative defenses.” These defenses can contain allegations, take the initiative against statements of facts contrary to those stated in the original complaint against them, and include various defenses based on legal principles. Many of these defenses fall into the “boilerplate” (stated in routine, non-specific language) category, but one or more of the defenses may help the defendant.

Below you will find the notice transposed in its entirety.

NOTICE OF AFFIRMATIVE DEFENSES OF DEFENDANT, DAIMLERCHRYSLER CORPORATION

NOW COMES the Defendant, DaimlerChrysler Corporation (“DC”), by counsel, and asserts the following Affirmative Defenses:

  1. No Negligence. Defendant DC was not guilty of any negligence which was a legal cause of any damages allegedly sustained by Plaintiffs’ decedent.
  1. Comparative Negligence. In the event that discovery demonstrates that Plaintiffs’ decedent was guilty of negligence which was the sole proximate cause of any damages allegedly sustained, plaintiffs’ recovery is therefore barred. Alternatively, in the event that discovery demonstrates that plaintiff’s decedents own negligence substantially contributed to the damages allegedly sustained, the recovery of plaintiff’s, if any, should be reduced proportionately.
  1. Third party fault. In the alternative, while continuing to deny any and all liability, DC asserts that plaintiff’s decedent’s alleged damages may have been the result of the negligence of third party over whom DC had no control and was not legally responsible. DC cannot identify such parties until discovery has been conducted. DC relies upon the doctrine of Fabre v. Marin, 623 So.2d1182 (Fla. 1993).

  1. Collateral source set-off. DC is entitled to a set-off for all payments made by collateral sources for bills, expenses, or other obligations which have been paid, or are payable to Plaintiff’s herein. Further, DC is entitled to a set-off for any settlements or compensation Plaintiffs may have received regarding the subject incident.

  1. Tort Reform and Insurance Act of 1986. Additionally, DC asserts that the incident herein falls under the provisions of the “Tort Reform and Insurance Act of 1986”. which said act specifically addresses, but is not limited to, joint and several liability and non-duplication of benefits. DC affirmatively pleads all of the defenses and rights available to it under said statute.

  1. Federal Pre-emption. Additionally, DC affirmatively states that it is entitled to any and all rights and privileges available to it under the Federal Pre-emption Doctrine.

  1. Apportionment of damages. Additionally, DC asserts that it is entitled to an Apportionment of damages in relation to the degree of fault of all parties, persons, companies or employers, whether joined as co-defendant or not.

  1. Mitigation of damages. In the event that discovery demonstrates that Plaintiffs failed to mitigate their alleged damages, the recovery of plaintiffs, if any, should be reduced accordingly.

  1. Intervening/superseding cause. In the event that discovery demonstrates that Plaintiff’s claim arose from a superseding and intervening causes unrelated to DC, then Plaintiffs claims are barred.

  1. Limitations of liability. Any recovery by Plaintiffs’ is limited by F.S.A. 324.021(9)(b).

  1. Failure to state a cause of action. Plaintiffs’ fail to plead the requisite elements of negligence to support a cause of action as required by Simon V. Tampa Electric Company. 202 So.2d209, 213 (Fla. 2d DCA 1967).

  1. Additional Affirmative Defenses. DC reserves the right to amend its answer to assert any additional affirmative defenses based upon either the law of Florida or facts and circumstances which may be disclosed throughout the course of discovery herein.

WHEREFORE, Defendant, DaimlerChrysler Corporation demands that plaintiffs’ Complaint be dismissed with prejudice and costs assessed against plaintiffs and further demands a trial by jury.

Daytona Beach Mayor Dead at 80

Yvonne Scarlett-Golden has been battling cancer since the beginning of the year when doctors found tumors in her digestive system. The Mayor, just released from the hospital on Monday to return home died Tuesday Morning.

Mayor Golden was elected in 2003 and re-elected in 2005 running against Daytona Businessman Rick Shiver. Daytona Bike Week campaign “ride quietly” was the idea of Mayor Scarlett Golden while she was active in all Daytona Beach “special events” as well as NASCAR and the Daytona International Speedway. Commissioner Rob Gilliland is expected to assume duties of the mayor, as he is currently serving as vice mayor.

Toy Run celebrates 25th Anniversary

Toy Run motorcycles filled the parking lot at BCC

(Melbourne, Florida) 12/03/2006 Since 1981 the Brevard Chapter of ABATE of Florida has held a toy run to benefit the less fortunate children of the county. With nearly 1,500 members the Brevard County Chapter of ABATE is the largest in the state. The turnout for the annual toy run today demonstrated the power of the organization.

Thousands of toys for the children

Each person was asked to bring an unwrapped toy or $10.00 donation to benefit local charities. Bags stuffed full of toys were loaded into a truck that will bring smiles to many families for Christmas.

The toy run, like many around the nation happen every year, but for the Brevard Chapter of ABATE, this year was special. This is the silver anniversary year for this group. For a quarter of a century the motorcycle rights organization has been getting together early December for the toy run.

 Bikers are great people and their charities will say the same

Today’s event began at the Merritt Square Mall in Merritt Island at 12:00 noon and ended at the Brevard Community College Wickham Park Pavilion. Enough motorcycles to stretch over a mile filled the streets from Cocoa Beach to Melbourne, Florida causing traffic delays along the route.

While in many cars along the route, drivers set frustrated in having to wait while the bikers pass, they are not aware of the good that bikers do for charities in the area. The event raised $4,000.00 and several truck load of toys to help nearly 700 families in Brevard County.

With the last bike leaving the starting point nearly an hour after the toy run began and close to an hour and a half of motorcycles landing at the BCC Campus in Melbourne, the place was packed. Looking a bit like bike week, the park crowded with bikers, vendors and a live band to celebrate a successful day.

Charity and fun, the toy run was a success

Bikers are great people! They can raise these types of donations for local charities and have a great time doing it. The weather for the toy run was great with the Florida temperature still in the high 70 to 80, its hard to believe it is December.

Can drunk driving be stopped

(Melbourne, Florida) 12/02/2006 Melbourne Police set up “sobriety check” to stop drunk driving 

Sobriety Check Ahead sign posted by Melbourne PoliceIn an effort to curb impaired drivers, the Melbourne Police were in place Saturday on Sarno Road in Melbourne.

A flashing sign warned drivers of the potential stop ahead that was being conducted between the hours of 6:30 to 8:30 and 1:00 til 3:00 am.

The Melbourne PD plans on setting up the same type of check point several times during the month of December.

The cars are chosen on a random basis of 1 in every 3 cars that approach the DUI check point up until 2:00 am when the ratio is set to every other vehicle.

Have you been drinking

Besides being able to detect the smell of an alcoholic beverage from a driver, the officers are trained how to detect other signs of impairment.

If the driver is suspected of DUI, they will be asked to pull in to the parking lot for further  field sobriety test and/or breathalyser and blood alcohol tests if necessary.

The required equipment for doing these types of tests were on hand in the adjacent parking lot.

While officers standing post during the early morning hours, (just after most bars and clubs close) to detour the potential drunk driver accident from happening. There are places that are open to keep the party rolling and alcohol is still being served.

Last Call Melbourne Florida

Melbourne bottle clubs are open that fill the gap for the drinker between the hours of midnight until six in the morning. On this Saturday night there were close to 30 cars parked outside the Melbourne BYOB club Last Call and 1  taxi cab.

The way this type of establishment gets around the 2:00 am alcohol serving rules, is they sell you back your own drink.

One cab waits outside the local Melbourne drinking establishment while club customers are active outside the bar, in the alleys and across the street in the bank parking lot.

Drunk driver smashes into pole is not injured

At approximately 2:35 am and just a mile or so from the DUI check point, a drunk driver smashes his car into a concrete light pole. The driver was not injured in the accident, but set on the curb close to his vehicle trying to recall what had happened.

While up the road police officers are trying to enforce the Florida drunk driving laws, other officers and fire department emergency medical team are investigating a crash that was caused by drinking and driving. The bottom line lies on the responsible driver decision to not drink and drive.

This time the driver hit a light pole and was not injured. It could have been another vehicle , injuring or killing another. The only way to stop drunk driving is to not drink and drive.

A visit with Cyril Huze

As a photographer in the motorcycle world I get to meet many interesting people. I also get to talk with the elite of the industry. I had a chance to drop by and say hello to master builder Cyril Huze the other day and spent a couple of hours just chatting.Cyril Huze and Mike Odom st his shop

We spent only a few moments in the shop as Cyril is in the middle of moving to a new location. 

The rest of the time we spent just getting to know each other. This was the first time that I had the opportunity to meet Cyril Huze.

Seems we have been to the same common places like bike week and biketoberfest in Daytona Beach, we just never had met.

This day was better than meeting at a biker event, we got to spend some time talking which would of not happened otherwise.

I do plan on visiting Cyril at his new shop once he gets moved and settled in. Then I will take more time to document and photograph this chopper builder’s work. The two bikes that I did get to see showed the originality and art of his work.Cyril points to oil tank designed behind seat of bobber

Cyril points out the design of a bobber that has the oil tank behind the seat. He designed this so that the lines to the cooler will be hidden.

When completed this bobber will accent more on the big engine that will be set in the frame with very little distraction of tube lines and cables.

I hope to be able to return and see this unique custom bobber when it has been completed.

As I entered Cyril Huze Customs, directly on the right were two frames. Ah yes, this is were it all starts, the custom motorcycle frame.The motorcycle frame, the start of it all This frame caught my eye right away because of the twisted metal design.

One that when asked brought a smile upon the face of this master builder. “I call this the tiki frame” said Huze adding that the frame is one of the only two made.

The other frame set to my left on a work rack with the engine, tires and a few components that were being added.

You can tell by the way that the parts are laid out in a meticulous fashion that each part is added one at a time with precision.

It comes to mind while I write this article and look back on my visit to the shop why people have a hard time calling chopper building a art.

To build a custom motorcycle starting with the hollow tubes that create a frame, adding custom parts and an engine. Creating a custom motorcycle with personality is arguably an art. A art that Cyril takes seriously.Cindi Odom with Cyril Huze

Of course my wife Cindi was present and took some pictures during our visit.

I will be returning to see Cyril the first of the year to visit his new shop and take a closer look at his work. Hopefully, I will have the chance to see some of these motorcycles in there completed state.
