State files response in Billy Lane DUI case
The State of Florida has released a list of persons that are intended to be called as witness(es) in the DUI Manslaughter case against Defendant, William D. Lane.
The list contains the names of 24 people that the State Attorney office says they may call to the stand to testify when the trial begins. The response also states that it has gathered as evidence the Traffic homicide investigation report filed by FHP Cpl. Corbett which is 83 pages long and an updated report of 6 pages. Evidence will also include a CD containing 257 photographs, one 911 audio tape and two audio tapes of interviews.
Just moments ago it was discovered that an autopsy report of the victim, Gerald Morelock showed he had been drinking. This will not have any effect on the charges that have been filed against Billy Lane because he was at fault in the crash.

The results of Mr. Morelock’s autopsy showing that he was legally DUI is very sad. Being impaired makes our response time slower and vision is not so good on A1A at night when one is as sober as a church mouse. I dare say Kepler Funk is going to dig in Mr. Morelock’s background from the day he was born. Hopefully the State will prevail in the criminal case. Mr. Lane sober or drunk should not have been driving or passing three cars on a double yellow line. I only want Mr. Lane to face the music the rest of us common folks would face the same music. I can not believe how many people are on our highways without legal drivers license.
If Billy would not have been driving…..Mr. Morelock would most likely still be alive and these conversations would not be on the web. How can one hate a guilty person just because he has money to pay for a high priced attorney and all the investigators to go with the high dollar lawyer. I must say if I was in the same boat and could afford a F.Lee Bailey lawyer I would. I believe most people would try to defend themselves the best way they can.
It saddens me that Morelock was drunk too. I thought he was just some poor guy coming home from work.

Well Mike is “BILLY” allowed to go to Vegas? I say probably “YES” with the courts permission and of course the bondsman. Remember, the guy who put up $15,000 to get our BAD BOY OUTLAW star out of jail? I looked at his Choppers. Inc. website after the above gave the internet world Billy’s MY SPACE ACCOUNT.
YES… I admit it I went there for the first time to His MY SPACE. I noticed in his profile that he wrote NO for Drinking and NO for Smoking. He says that he is in a RELATIONSHIP. Looks like he quit drinking right after he had all the drinking pictures removed from BOTH websites.
For the Billy Hater pictures….how could they be put on his site without his knowledge? You saw it on Choppers,Inc. television. I also noticed that Billy is spending the winter 2007in the shop developing new parts. Billy has finished his traveling. Guess he is tired??????

The fact that the decedent, Mr. Morelock, was legally intoxicated should have no consequences on the criminal or civil aspects of the case based upon the evidence I have heard so far. Mr. Morelock did not do anything to cause the crash, and he had the right of way in the lane that he was in.
Unless some witness comes forward and says that it was Morelock who swerved into Billy Lane’s lane, I do not see any problems with any of the cases.
Mr. Morelock it appears was legally drunk. He still had a right not to be killed on a Public Highway. I once did a case for a woman who was legally drunk with six kids in her van. She was rear ended by a guy in a truck. She was arrested and convicted for DUI after the accident. I received a large settlement for her in the civil case because she was not at fault in the accident. I am sure the same thing will happen here in the Billy Lane Case.
I am sure you guys remember the OJ case, and the Robert Blake case. There is no doubt the defense will try to attack Mr. Morelock anyway they can. Unfortunately its easy to attack someone who is no longer alive to defend themselves. This may have some affect on the jury. In the end we will see.

The fact that Mr. Morelock was impaired in my opinion does not change the outcome. He had
zero reaction time and was within his lane of travel.

You are absolutely right Oso G.
It does not remove the fact that Billy Lane was driving on a suspended license, nor that he was passing in a “no pass” zone that was clearly marked with a double yellow line.
In fact, if we recall, Mr. Morelock was riding in the style of most motor scooters and keeping to the right side of the road. The traffic report states that he was 2 ft. 5 inches from the white line upon impact.
This may have even been an attempt on his part to get out of the way of the oncoming truck that struck him!

Do the crime, do the time. Seems pretty straight forward to me. Billy gets drunk, trys to drive home, people are driving to slow for him, passes them, kills someone. End of story.

I am sure that Billy Lane wishes he had not been in such a hurry to get home. I guess he had some kind of burning desire to get there as FAST as he could…….maybe Erin was doing the dirty and he was on “FIRE”. Yes our actions have consequenses and Billy did the crime and he MUST be punished. It is ashame that because of ones ability to pay a high priced attorney justice is not always equal for everybody.
