Site updates at the Mike Odom blog

Hello Readers,
I have decided to use a different software for my blog. Although the current b2evolution works well, it has some issues and does not have the benefits of Word Press.

I am currently changing the software over to the Word Press post by post. If you want to have a sneak preview of what the site will look like check it out here.

There is supposed to be a way to move the database form on to the other, I just don’t think it will work. I want to try to keep the links and pages (including comments) in tack.

However, you may notice some outage and dead links in the next few hours or days. I will try to get the site back up and running with the new software installed by Monday. Be sure to check it out. I will be releasing another exclusive article (hopefully) on Monday as well.

A turkey to be proud of

I love to cook and I usually cook the holiday meals for Thanksgiving and Christmas for our family. This year for Thanksgiving was no different, other than most of the family would not be here. Normally, I cook a Thanksgiving Day feast for about 16 people. Today there was only 5 of us so I only did a turkey dinner.

It was a big bird, 18 pounds! I used to cook my turkey in the oven wrapped in paper shopping bags. The paper bag holds in the juices and flavor and makes a very tender dish. It has to be slow cooked when you use a paper bag at about 225 F for two reasons. The turkey will turn out very tender and the obvious, it keeps the bag from catching fire.

Back a couple of Christmas ago, my wife and I received a roaster oven from her brother David. The kitchen tool has proved to be one of the most useful cooking appliances that I have. There is not much that I can not cook in this thing, including a Thanksgiving Turkey.

I still slow cook the turkey in the roaster, but have eliminated the paper shopping bag. The turkey still comes out juicy and tender cooked over night.

This turkey looked good when it came out after being slow roasted for 14 hours, but look at the way it slices! The dressing was home made from scratch, none of that pepperidge farm stuff. Needles to say, I was full when I walked away from the meal that I cooked today.

Already, rumors have hit the Internet about the popular video game. Reports of pre-sale prices skyrocketing to over $9,000.00 on eBay and earlier today stories were told of eBay halting the pre sale of the PS3 games.

I did not see this supposed sale of over nine thousand dollars, it was called in to the Philips Phile a local radio talk show on Real Radio 104.1 this afternoon. The rumors of eBay halting the auctions of the presale receipts was just that, a rumor.

They (eBay) did make a new set of specific rules for the pre-sale of PS3 games on the eBay auction site where the sales of the game are still hot.

I called the local Wal-Mart here in Melbourne, Florida to see how they were handling the sale of the Sony® PS3. The Wal-Mart electronics department told me that the game would not be available until after midnight on early Friday morning. They also told me that there was already a line waiting. I had heard that people were willing to camp out at the local Wal-Mart and wait in line, so we took a ride over to see the people in line.

Chris Cline of Melbourne, Florida was 2nd in line at the Wal*Mart where the line already had 10 people waiting. Chris told me that he had been in line since 10 am and came prepared to stay the night outside. Chris is planning on giving his prize to his brother.

Ryan Elmusian of Melbourne has been in line since 11:00 am and says he plans on keeping his new Play Station. It looks like the Play Station camp out may become an annual event for Christmas Shoppers.

I watched in amazement as the sales of the popular PS3 video game went soaring through the roof on eBay the next day. I took screen shots of the closing bids of 2 more auctions that went for top money.

State files response in Billy Lane DUI case

The State of Florida has filed a response to notice of discovery in the criminal case against Billy Lane.(Melbourne, Florida)
The State of Florida has released a list of persons that are intended to be called as witness(es) in the DUI Manslaughter case against Defendant, William D. Lane.       

The list contains the names of 24 people that the State Attorney office says they may call to the stand to testify when the trial begins. The response also states that it has gathered as evidence the Traffic homicide investigation report filed by FHP Cpl. Corbett which is 83 pages long and an updated report of 6 pages. Evidence will also include a CD containing 257 photographs, one 911 audio tape and two audio tapes of interviews.

Just moments ago it was discovered that an autopsy report of the victim, Gerald Morelock showed he had been drinking. This will not have any effect on the charges that have been filed against Billy Lane because he was at fault in the crash.

Vietnam Veterans Memorial, bringing home the wall

Veterans Day weekend is upon us.

Bringing Home The Wall

No better time for me to introduce to you a couple of my friends and their Vietnam Veterans Memorial. Tom and Dee Twigg of St. Cloud Florida began the project back in 1996.

They were at a Pow Wow for Thanksgiving and had set up a table with a chair that had only a uniform to honor those missing in action and prisoner of war.

A elderly women in a wheelchair approached the table. She had with her a Bronze Star and Purple Heart medal with citations that had belonged to her son who lost his life in the Vietnam war. She told them that because of her failing health, she feared that she would not be able to make it to the Vietnam Memorial Wall in Washington D.C. She wanted to leave the items at the table in his memory.

Dee Twigg told the woman to hold on to the medals for one year and they would bring the wall to her so that she could leave it there. Tom and Dee began constructing a small replica of the Vietnam Memorial Wall and returned to the same Pow Wow the next year. The woman was there with her son’s medal and laid them at the base of the wall in his remembrance. It was a very touching sight for the Twiggs and from that came the idea of Bringing Home the Wall.

The original wall that Tom and Dee created was on white paper and framed in panels to replicate the original wall in Washington DC. The concept was created when the Twiggs saw that there were many that simply could not get out to see a traveling wall, much less make the trip to Washington DC. So they have created a Vietnam Veterans Memorial that can be displayed indoors at Veteran’s hospitals and nursing homes. Places where there are people that are not able to get out because of health and/or financial abilities.

I met Tom and Dee at their display they had setup during Bike Week 2005 in Daytona Beach, Florida. My wife and I stopped in to take a few pictures for our Bike Week site and talked with the couple for a few minutes. As we walked away from the wall, we discussed what nice people we had met and wanted to help them. We turned around and discussed a web site for their cause. Turned out that they did not have one. Because web design is something that I do, we offered to build and host a web site as our donation toward helping the Vietnam Veterans Memorial. We have become close friends since that day and we try to get out to help and show support wherever the wall is being displayed.

The wall has been completely redesigned by Tom and Dee to look even more like the actual Vietnam Memorial. The wall now stands almost 8 foot tall at the tallest point and is printed on black laminated plastic with white lettering. The new wall was constructed and designed by the Twiggs in May of 2006 with very little financial aid to them. The only financial aid that the Twiggs receive is that of the modest donation jar that they put up at the wall during public displays. Usually the amount taken in is short of covering the expenses of transporting and setting up the wall.
This weekend on November 11th you are invited to come out and visit the wall. The Bringing Home the Wall Vietnam Veterans Memorial will be set up at the Lakeland City Center for you to visit. The wall will be escorted in to town by the U.S. Military Vets MC and there is to be a candle light walk to the wall at 6:30 pm. You can find more information on the Lakeland City Veteran’s Day activities at the City of Lakeland web site. They are calling the day A Celebration of Heroes and it will include musical entertainment, a parade and a welcome home for troops returning form the 116th and 495th. Come on out and show your support for the returning troops and those who have given the ultimate sacrifice for our country.

It happens all the time

I have heard the comment “It happens all the time” and yes it does. As a matter of fact it happens every 20 minutes. Every 20 minutes someone dies because of driving drunk.

So why is the case of Gerald Morelock any different than these other people that became the victim of a DUI? Because it happened at the hands of Billy Lane a well known chopper builder? Because it happened in my hometown of Melbourne, Florida? Well, I suppose all of these build into the equation, but I am not so sure that is the very reason.

I think the thing that bothers me, and others, the most here is the way that he (Billy) has chose to ignore what happened. I guess it appears that by doing so, he has chose to ignore those who made him well known. I have read other articles that use the word “famous” to describe Lane. In reality he is not so famous. I think that the word “noted” better describes Billy Lane as far as the world goes. He may be famous in the world of motorcycles and enthusiast, but it stops there.

Billy Lane was scheduled to appear in court yesterday on November 9th for pretrial or docket sounding. DOCKET SOUNDING is the last effort of the Judge and the attorneys involved to schedule specific days and times for trials just prior to the beginning of the trial docket. Lane was not present because he filed a waiver of appearance through his criminal attorney Kepler Funk. The criminal case against Billy Lane is now set for yet another docket sounding on February 2, 2007.

So, there is going to be a bit of time spread in the criminal DUI Manslaughter case that faces Billy Lane. Will this help us to forget it? No. I think not. At least not for me. I intend to watch this one through until justice has been served. To many this raises another topic all together, one that I will not address other than to say that it is the way this country is run. The system may have many flaws, but it is ours to live with. This case will be heard and as Americans we will have to abide by what is written and what the jury decides.

It looks as though the defense attorneys in the civil case against lane for the wrongful death of Gerald Morelock have chosen to take advantage of the stall in the criminal procedure by filing a motion for speedy trial. That is not a bad thing, yet, I can’t help but think that it will be somewhat effected by the delay in evidence and discovery in the criminal case. It will certainly make the investigators have to work a bit harder to obtain evidence on their own.

While the two cases certainly have no bearing on one another by way of outcome, the civil trial attorneys can use evidence that would not be admissible in the criminal case. I will also be looking for the response from the defense that is due in by the 12th of this month.

Many that have been following the tragedy that took the life of Gerald Morelock did not know him, I am one. Although we have probably been in the same places, like Gerry did, I like to fish for snook.

Gerry loved the Sebastian Inlet so much and for him, he had a good job working there.

You may wonder why I am only now writing a full article about Gerry Morelock. The truth is, it has taken me this long to make contact with the family of Gerald Morelock. I am not one to use pictures or text from other sites without permission. I now have the permission of Gerry’s brother Byron to do so.

The picture above is one that was used in most newspaper articles, but there are others that I found and wanted to share with you. I have been in contact with Byron Morelock and Gerry’s nephew Seany in order to bring you the pictures of Gerry and his family.

This is a picture of Gerry’s Brother Byron (left), his Nephew Seany (center) and his Mother June (right). Sean and Gerry were very close and spent a lot of time together. This picture was taken the day that everyone said goodbye to Gerry Morelock at the inlet park. Gerry’s ashes were spread over the water where he worked and played. Byron said the sunset that day was one of the most awesome ones he had ever seen.

Gerry loved his family and spent a great deal of time with them all. I want to mention here that many of these pictures were posted at Club Chopper and that most of the folks in that forum are very supportive of the Morelock family.

I want all to know just a little more about Gerald Morelock. The following was written and read by Bill Amis, Gerry’s best friend.

To say Gerry was one-of-a-kind would be an understatement. He was my best friend for the past 21 years — my sounding board, my teacher, my ally and my soul brother.
Since we were both bachelors and shared the same interests, we had a bond that was solid, pure, and unshakable. He was the most unselfish and non-judgmental person I have ever had the good fortune to know.
Friends like him don’t come along very often, and I felt honored and privileged to have someone in this world I could relate to in such a warm, trusting, and effortless manner. He was always on my side and there for me. The me you see would not be if not for his patience, caring, guidance, and support.Gerry had a big heart, a dry wit, a sharp mind, and a memory like an elephant. He once had a dog named Max that he loved and never forgot, and also tried once to raise a puppy named Dammit!, but that’s another story. His family and friends were priceless to him, and he loved and cherished and treasured his mother June, his brother Byron, his sister Dawn, his niece Chelsea, and his nephew Sean. I’m sure there are other family members I should recognize, but I don’t know their names.He spoke of his father often, and I know that he had made peace with him and loved him very much, too. I will miss Gerry’s great, big, fuzzy bear hugs.Gerry lived his life like a Warrior/Priest on a spiritual quest in pursuit of answers to the big questions. There is a cartoon I cut out of a New Yorker magazine recently and showed him. It’s a picture of a man walking down a path who comes to a fork in the road with a sign pointing in two directions. One way leads to The Meaning of Life and the other points towards Cheese and Crackers. Most people go for the cheese and crackers, but Gerry wanted to find the meaning of life, and was passionate and devoted to that search.I will always remember a famous quote he used to repeat. I must have heard it a thousand times. It was by Martin Luther, and in German. I never learned to pronounce it correctly, but it went something like, “Hier stehe ich, und kann nicht anders” which meant: “Here I stand and can do no other”. The reason it was important was because it expressed a fact of his life. Everyone has experienced hardships in life, has had rough times or met with difficulties or adversities that caused pain and suffering, but Gerry had more than his fair share.The way he was able to bear his suffering and handle those burdens was truly an inspiration to everyone who knew him. He was the strongest, kindest, most compassionate, and understanding person I ever met and I loved him deeply. He knew everything about me and I could tell him anything.Gerry introduced me to Buddhism and the wisdom of Eastern Philosophy. He taught me to meditate, to breathe properly, and to love my enemies. He never held a grudge, but sought to live in harmony with all things. He had no prejudices and respected all races, creeds, and colors.If we ever got mad or frustrated with each other, he was always the first to reach out to patch things up. I can’t ever remember a time when he hurt my feelings. Because we were so close and knew each other so well, I believe I can honestly say that I never saw a wrong done to him that he couldn’t forgive. He was a gentle soul who would not wish harm, guilt, shame, or suffering on another human being.

Everything I know about religion, I learned from him.
Gerry loved music, and one of his favorite artists was Dead Can Dance. I would read you the lyrics to one of their songs called Ulysses, but I couldn’t get through it without breaking down, so I encourage everyone to just Google the lyrics and download it for free if you know how. It’s about a man’s journey, or odyssey, of self-discovery, in which, like I imagine Gerry has now done, he takes off his mask and crosses the Rubicon: “for tonight he must leave, with the first gentle breeze, for the Isles of Ken he is assailing.”

In closing, let me also refer you to that song by Don McClean, Vincent, about Vincent Van Gogh, and the line that is so fitting to my dear friend Gerry — which I said to him on so many occasions: “this world was never meant for one as beautiful as you.”

But I’d hate to end on a sad note, so let me tell you about something that happened last Sunday morning…

Get out and vote

It seems too often that when someone is speaking about what is wrong with the way things are in America or what needs to be changed, that person did not vote!

Quite simply folks, if you did not vote, it is not your place to speak out on issues that need change. The reason that our government is so unbalanced and issues are thrown aside, is because of the apathy in our country. The shaping of the government and how this country can be run starts with you and I. I urge all of you to get out and vote today.

Voting is important, but more important is to vote with knowledge. Know your candidates and the issues that are going to be on the ballot. Do a little “digging” into what each of the candidate’s platform is. Check into their past and research their votes on issues that are important to you and your family.

This mid-term election puts Floridians in a great position to see change with the opportunity to vote for a new Governor. Jeb Bush has reached his term limit and there are two new candidates up for the seat. If you have not looked at the two candidates that are running for Governor of Florida, its not too late.

A big issue in the gubernatorial race for Florida is the rumor of Charley Crist being a homosexual. The better part of the homosexual community appears to believe that he is and several people have come forward with last minute statements confirming that he is. The fact that he has denied it does not mean that he is not. If Crist is a homosexual and it comes out after he has been elected, it will only mean another government sex scandal. Crist’s opponent, Independent Max Linn claimed on a Florida radio show that it was “common knowledge in Tallahassee that Crist is gay.” Its sad that this type of statement is taken so lightly. This is a government official currently in office and running for the highest position in the state.

I am not willing to accept a homosexual in any government capacity at all. This is why I urge all to get out and vote. If you want to vote for a homosexual for Governor, that is your right. Rather, if you chose not to vote, you may not have that right in the future.

Billy Lane adds another attorney to defense team in civil suit

Taking a look at the “DEFENDANT’S MOTION TO DISMISS” in the civil action for the wrongful death of Gerald Morelock filed against Billy Lane, the motion is very basic in its composition.

The motion was filed by Jeffrey Vernis ESQ of the Palm Beach law firm Vernis & Bowling on October 26 with the Brevard County Clerks Office in Viera.

The case record now reflects that Billy Lane has added another attorney on his defense team in the civil action. Newly added attorney Terence R. Perkins is partner of a Daytona Beach law firm that handles both criminal, personal injury and insurance law.

There is still no attorney of record listed for DaimlerChrysler the other defendant named in the suit. However, the law firm of Vernis & Bowling does list DaimlerChrysler corporation as one of their clients. There has been no official statement released from the DaimlerChrysler corporation yet regarding the suit.

The attorney for the plaintiff, Dolores J. Morelock is Sammy S. Cacciatore JR of the Melbourne law firm Nance Cacciatore. Sammy S. Cacciatore filed a auto negligence suit against William D. Lane and the DaimlerChrysler corporation on October 2 for the wrongful death of Gerald V. Morelock. Mr. Morelock was killed on September 4 when the pickup Billy Lane was driving hit him head on while riding his 1983 Yamaha motor scooter. A crash report filed by the Florida Highway patrol stated that Billy Lane had crossed the double yellow lines on Highway A1A in an attempt to pass 3 vehicles. The report also found Billy Lane to be under the influence of an alcoholic beverage with a blood level of 0.192.

What you are about to read are lines taken from the actual motion to dismiss filed in the case. You will notice links on some of the legal terms by the difference in color of text. These links when clicked on will take you to the definition of that legal term to give you a better understanding of what this document is saying.

I have chose to use the law dictionary at www.law.com for this purpose, as I think that the definitions in their dictionary are more concise, yet easier to understand for the common layperson.

OK, so on with the motion:
1. This is a wrongful death action filed on behalf of the Plaintiff, resulting from an automobile accident, which occurred on or about September 4, 2006.

2. That Plaintiff’s complaint against this Defendant purportedly is predicated upon negligence, however, the Plaintiff has failed to state a cause for action for negligence.

3. That in count 1 of the Plaintiff’s complaint, the Plaintiff purportedly alleges a claim for negligence, however, no where within its count, except for the heading does it set forth the required elements of negligence, specifically: (1) a legal duty to protect the party seeking relief under the circumstances; and (2) negligent failure to comply with said duty.

4. In order to state a cause of action for negligence, the above two elements, together with an allegation that the injury to the party seeking relief was a result of the negligence, and a claim of damages must be pled. See Cintron V. Osmose Wood Preserving, 681. So2d 859, 861 (Fla. 5th DCA 1996).

Wherefore, the Defendant requests that this court enter an order dismissing Plaintiff’s Complaint against, Defendant, William D. Lane.
