Intent is no longer an issue

Back when the news of chopper builder Billy Lane causing a fatal accident first came out, there were many questions.

Looking back at my posts on the subject and as I read the closing remarks of “when heroes become bad guys” I said that I knew that it was not intentional what happened.

Weeks later the reports of Billy drinking all day, bar hopping and a blood alcohol content of 0.192 removes “intent” from the incident.

The issue now becomes knowingly.
Billy Lane knowing he was intoxicated chose to continue driving, he knowingly passed in a no passing zone. I think it is safe to say that he knew he was driving illegally by his refusal to a blood test.

Let’s take a look at how dictionary defines knowing also we can take a look at the word knowingly
when we look at the definition of the word we can see that because he knew the facts above, it shows intent with knowledge.

Therefore by my knowing now what I did not know then. I can no longer say that it was not intentional. Having the knowledge or knowing can make the difference of intent.

      When you have a driving violation in another state where your driving previledges are revoked, aren’t you suppossed to get a letter from Fl. Dept of Motor Vechile or some other GOVERNMENT office telling you you have no license? These days they scan your license like a creit card and your whole life’s driving record comes up for who ever scanned your license?? I voted in the primary election and they asked for my drivers license instead of my votors registration card.

      I had a leased Dodge Ram… red like Billy lanes only no custom paint job. I was made by the lease agreement to buy $300,000 liability unsurance… the most you can buy in Fl. I believe that is all you can sue for in Florida. Of course…civil suits can clean out your bank account. Choppers Inc. is incorporated. I am not so sure Billy hired the best lawyers.

      I would have hired F.Lee Bailey, Willie Gary, Gerry Spense or OJ Simpson’s team. Never heard of Kepler Funk and his group till I read who Billy hired to repsent him on the criminal charges here in Florida. I can’t wait to read what happens tomorrow morning in Rowan Co. North Carolina. If convicted up ther he will be facing charges on a second DUI here. Billy is in a lot of trouble. Hope he paid his lawyers up front.

      I am curious if anyone sues DODGE….VERY DEEP POCKETS> Sur is sad Billy was only a mile from his house before he killed somebody coming home from work.

      I have had 2 DUI and knew when I got behind the wheel I was DRUNK. I am sure Mr Lane also knew. He has a history of DUI. Let the court send a message that we will not tollerate peolple killing motorcyclist when DRUNK. I feel Miss Billy should be someones bitch in his DOWN TIME. Just a bit of justice for killing one of us. If I had killed someone I would expect the same. I was lucky. Coindolences to the family of the man slain by Lane.

      Everybody knows you should not drive DRUNK and everybody should know they need valid drivers license to drive period!!!

      I agree that he did infact KNOW he was too drunk to drive but the intent thing well…yes he INTENDED to pass illeagally, but i highly doubt he INTENDED to kill that man. Accidents are called that for a reason. So lets not get too down on him. Also I just wanna say before anyone takes this the wrong way, yes I do feel what he did was wrong and that he does deserve punishment, but It couldve happened to any one of us.
